Please read this Agreement carefully before making a reservation. It contains important payment, cancellation, travel-risk, and participation provisions.

1. Parties and Agreement

This Agreement is between ARS Media, LLC, a Texas limited liability company operating under the Andrew Slaton Photography brand (“Organizer”), and the person reserving a place on the expedition (“Participant”).

By affirmatively accepting this Agreement and completing a reservation, Participant agrees to its terms.

This Agreement governs the expedition identified above and supersedes conflicting general website terms concerning that expedition.

2. Expedition Description

The expedition is an eight-day, small-group photography experience in the Torres del Paine region of Chile, emphasizing landscape photography, photographic instruction, and exploration of the Patagonian environment.

The expedition accommodates a maximum of five paying guests.

The itinerary is photography-focused and may be adjusted in response to weather, light, road conditions, park regulations, accessibility, safety, and other circumstances.

Specific photographic locations, wildlife encounters, weather conditions, and photographic results are not guaranteed.

3. Included Services

The $9,000 expedition price includes:

  • Eight days of guided photography activities and instruction.

  • Seven nights of shared accommodations.

  • Designated arrival and departure airport transfers.

  • Ground transportation for scheduled expedition activities.

  • Torres del Paine National Park entrance fees.

  • Photographic guidance from Andrew Slaton.

Single-occupancy accommodation may be available for an additional fee, subject to availability and written confirmation.

4. Exclusions

The expedition price does not include:

  • Meals and beverages.

  • Airfare.

  • Personal purchases and incidental expenses.

  • Travel insurance.

  • Emergency medical treatment or evacuation expenses.

  • Optional activities or services not expressly identified as included.

Participants are responsible for any applicable passport, immigration, or entry requirements and related costs.

Any other material exclusions must be disclosed in the final expedition information before booking.

5. Reservation and Payment

The total expedition price is $9,000 USD per person.

A $3,500 deposit is payable when reserving a place. This amount is applied toward the expedition price.

The remaining $5,500 is due on December 1, 2026.

Participants who select a scheduled payment plan authorize the payment schedule expressly disclosed during checkout.

For reservations accepted after December 1, 2026, the full expedition price is due at booking unless otherwise agreed in writing.

A reservation is subject to the Organizer's acceptance and the terms of this Agreement.

6. Seven-Day Cancellation and Refund Window

A Participant may cancel within seven calendar days after completing their reservation and receive a full refund of all expedition payments collected by the Organizer.

Written cancellation notice must be received by the Organizer within that period.

If an installment is collected during the seven-day cancellation period, it is also refundable when the Participant cancels within the period.

This provision does not restrict any additional rights provided by applicable law.

7. Participant Cancellation After Seven Days

For cancellation after the seven-day window but before December 1, 2026, the $3,500 deposit is retained as a cancellation charge, subject to applicable law.

For cancellation on or after December 1, 2026, the full expedition price is nonrefundable, subject to applicable law and any express exceptions in this Agreement.

These charges are intended to account for advance supplier commitments, the difficulty of replacing a guest in a small-group expedition, administrative costs, and lost booking opportunities. They are not intended to constitute an unlawful penalty.

If the Organizer cancels the expedition, Section 9 controls instead.

Participants may request a transfer to a replacement guest. Transfers require prior written approval, acceptance of the booking terms by the replacement participant, and payment of any additional supplier charges. Approval is not guaranteed.

8. Failed or Missed Payments

If a scheduled payment fails or remains unpaid, the Organizer will notify the Participant in writing.

The Participant will have seven calendar days following notice to resolve the outstanding payment, unless applicable law requires additional time.

If payment remains outstanding, the Organizer may cancel the reservation and apply the cancellation terms, subject to applicable law.

The Organizer will not automatically treat a failed payment as a voluntary cancellation without the notice described above.

9. Organizer Cancellation and Minimum Enrollment

A minimum of two paying guests is required for the expedition to operate.

The Organizer will confirm whether the expedition will proceed no later than January 1, 2027.

If the minimum enrollment has not been reached, the Organizer may cancel the expedition by that date.

The Organizer may also cancel if serious safety concerns, unavailable essential services, or other circumstances prevent the expedition from operating as reasonably planned.

If the Organizer cancels the expedition before departure, all expedition payments received from the Participant will be refunded in full.

The Organizer will issue applicable refunds within 14 calendar days of cancellation, or sooner if required by law.

The Organizer is not responsible for separately purchased airfare, additional lodging, or other independent travel expenses, except where applicable law provides otherwise.

Participants are strongly encouraged to purchase refundable or changeable airfare and appropriate travel insurance, particularly before January 1, 2027.

The Organizer may confirm the expedition earlier if minimum enrollment and essential arrangements are secured.

10. Itinerary Changes

The Organizer may make reasonable itinerary adjustments because of weather, photographic conditions, access restrictions, park regulations, transportation disruptions, or safety considerations.

Comparable substitutions and reasonable schedule changes do not automatically entitle Participants to refunds.

If a substantial predeparture change materially alters the essential nature of the expedition, the Organizer will communicate the change and address available alternatives and applicable refund rights.

Nothing in this section limits mandatory consumer rights.

11. Participant Responsibilities

Participants are responsible for:

  • Maintaining valid travel documentation and satisfying applicable entry requirements.

  • Providing accurate booking information.

  • Bringing suitable clothing, footwear, photographic equipment, and personal necessities.

  • Following reasonable safety instructions and local laws.

  • Respecting fellow guests, wildlife, local communities, and protected environments.

  • Communicating accessibility needs or relevant participation considerations that require advance arrangements.

The Organizer will provide available information about expected physical activities and conditions before booking.

12. Travel Insurance

Comprehensive international travel insurance is strongly recommended.

Participants should consider coverage for trip cancellation, interruption, medical treatment, emergency evacuation, repatriation, delays, and photographic equipment.

Participants are responsible for reviewing insurance exclusions, coverage limits, and claim conditions.

The Organizer does not guarantee reimbursement by any insurer.

13. Acknowledgment of Risk

International outdoor photography expeditions involve inherent risks, including severe weather, strong winds, uneven terrain, transportation incidents, wildlife encounters, and potentially delayed medical assistance.

Participants acknowledge that these risks cannot be eliminated entirely.

A separate participation acknowledgment and liability waiver may be required before departure.

Nothing in this Agreement waives rights or excludes liability where prohibited by applicable law.

14. Participant Conduct

The Organizer may restrict participation in activities when reasonably necessary to protect safety or comply with legal requirements.

Serious dangerous, unlawful, threatening, or persistently disruptive conduct may result in removal from the expedition.

Where reasonably practicable, the Organizer will explain the concern and provide an opportunity for correction.

Any financial consequences will be determined in accordance with applicable law and the circumstances involved.

15. Third-Party Providers

The expedition may involve independent accommodations, transportation operators, local guides, and other suppliers.

The Organizer will exercise reasonable care in selecting and coordinating services for which it is responsible.

Participants must comply with reasonable supplier safety rules.

This section does not exclude responsibilities that cannot legally be excluded.

16. Photography and Promotional Permissions

Participants retain ownership of photographs they create.

The Organizer retains ownership of its original instructional materials, written guides, trademarks, and other proprietary content.

Participation does not require granting the Organizer permission to use a guest's likeness, voice, or photographs for advertising.

Any promotional media consent will be obtained separately and voluntarily.

17. Personal Information

The Organizer may collect and process personal information reasonably necessary for bookings, expedition logistics, supplier coordination, and emergency response.

Information will be handled in accordance with applicable law and the Organizer's published privacy policy.

18. Events Beyond Reasonable Control

Natural disasters, severe weather, government restrictions, border closures, civil disturbances, or significant transportation disruptions may affect the expedition.

The Organizer will communicate material disruptions and make reasonable efforts to identify alternatives.

Applicable cancellation, refund, and consumer-protection rights continue to govern. This section does not independently eliminate those rights.

19. Governing Law and Disputes

This Agreement is governed by Texas law, except where mandatory laws of another applicable jurisdiction require otherwise.

The parties agree to attempt good-faith resolution through written communication before formal proceedings, without restricting legal rights or remedies.

Any exclusive venue, arbitration, or attorney-fee provisions require separate legal review.

20. Entire Agreement

This Agreement, the confirmed expedition description, the applicable payment schedule, and any expressly incorporated written booking documents constitute the agreement concerning this expedition.

Material changes will be communicated and agreed to as required by applicable law.

If a provision is unenforceable, the remaining provisions continue to apply to the extent legally permitted.

21. Participant Acceptance

By affirmatively accepting this Agreement, Participant acknowledges that they have reviewed:

  • The $9,000 expedition price and $3,500 deposit.

  • The December 1, 2026 final-payment deadline.

  • The seven-day cancellation and refund window.

  • The subsequent cancellation charges.

  • The minimum enrollment of two guests.

  • The January 1, 2027 expedition confirmation deadline.

  • The included and excluded services.

  • The inherent risks and potential itinerary changes associated with international outdoor travel.
